This website is owned and operated by Mind Shift 4 You, LLC (hereafter referred to as “MS4Y”).

By visiting our websites and accessing the information, resources, services (including live, virtual, and on-demand), products, and tools we provide (hereafter referred to as “Sites”), you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as “Terms of Service” or “ToS”), along with the terms and conditions as stated in our Privacy Policy.

We reserve the right to change these Terms of Service from time to time without notice. You acknowledge and agree that it is your responsibility to review these Terms of Service periodically to familiarize yourself with any modifications. Your continued use of our Sites after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

All content and materials available on MS4Y Sites, including but not limited to text, graphics, website name, code, images, logos, published works, community and program names, and all materials provided within our programs (including course content, documents, blog articles, worksheets, exercises, videos, and coaching resources) are the intellectual property of MS4Y and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display, or transmission of any content on this site, is strictly prohibited unless specifically authorized by MS4Y.

Unless otherwise noted, you may access and use the information and materials within our Sites for your personal use. You may not change, modify, delete, display, transmit, adapt, exploit, or copy for distribution or sale any information, material, trademark, or copyright on our Sites. You must obtain written permission from us or any other entity that owns intellectual property on our Sites before you may publish, distribute, display, or commercially exploit any material from our Sites. By using our Sites, you agree to abide by all copyright notices or other posted restrictions.

Citations and Attribution

Any references to MS4Y proprietary content, including excerpts from Sites, content, worksheets, materials, methodologies, and programs, must receive prior written approval. Citations should provide proper attribution and must not misrepresent our teachings, programs, or methodologies.

These terms of use apply only to our Sites and not to the Sites of any other companies or organizations that we may link to. We do not maintain, create, endorse, or take any responsibility for the contents, advertising, products, or other materials made available through any other Sites, including those we link to. Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of any content, goods, or services available on any other Sites.

Other Sites may link to our Sites by permission only. To seek our permission, you may contact us here. We reserve the right to rescind any permission granted to you or any organization in which we approve linking to our Sites and to require termination of any such link to any of our Sites at our discretion at any time.

Cancellation Policy

When you become a customer by purchasing any of our products or services, or by providing verbal or written authorization to become a member of the MS4Y team or community, you are agreeing to comply with the terms of the cancellation policy that applies to that purchase. Certain product offerings, to be determined on a case-by-case basis, are non-refundable.

Refunds are only available for programs that explicitly state a guarantee, and they must be requested according to the terms outlined for that specific product, service, or program. Any refund requests that do not meet the stated conditions will not be honored.

In the event that a company leader places an order on behalf of their company, you understand that by making purchasing decisions on behalf of the company, the company is held responsible for the purchase and must see the financial commitment through to completion.

Registration

We may, at our discretion, suspend or terminate the registration of any MS4Y customer, Community member, or general user who violates any of these terms of use or any of the Community member guidelines or for any other behavior that we, in our sole discretion, believe is inappropriate.

Disclaimers

The information, services, products, claims, seminars, coaching, and materials on our Sites are provided “as is” and without warranties of any kind, either expressed or implied. We disclaim all warranties, expressed or implied, including but not limited to implied effectiveness of the ideas or success strategies listed on this Site as well as those that are provided in our products or to our participants at our events or in our coaching sessions. We cannot control how our ideas or success strategies are implemented by any individual.

Neither we nor any of our respective licensors or suppliers warrant that any functions contained in our Sites will be uninterrupted or error-free, that defects will be corrected, or that our Sites or the server that makes them available are free of viruses or other harmful components. Neither we nor any of our respective licensors or suppliers warrant or make any representations regarding the use. or the results of the use. of the services, products, information, or materials on this Site in terms of their correctness, accuracy, reliability, or otherwise. You (and not we or any of our respective licensors or suppliers) assume the entire cost of all necessary servicing, repair, or correction to your system. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you. We do not endorse, warrant, or guarantee any speakers, products, or services offered on our Sites or those we link to. We are not a party to, and do not monitor, any transaction between MS4Y users and third-party providers of products or services.

Limitation of Liability

Under no circumstances, including but not limited to negligence, will we or any of our licensors or suppliers be liable for any special or consequential damages that result from the use of, or the inability to use, the materials or information on our Sites, or any products or services provided pursuant to our Sites, even if advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages (including but not limited to lost data), so the above limitation or exclusion may not apply to you. In no event shall the total liability to you by us or any of our licensors or suppliers for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you to us, if any, for accessing our Sites.

The information contained in or made available through our Sites (including but not limited to information contained on message boards, in text files, or in chats) cannot replace or substitute for the services of trained professionals in any field, including but not limited to financial, medical, psychological, therapeutic, or legal matters. By providing your phone number, you agree to receive text messages from MS4Y. Message and data rates may apply. Message frequency varies. You can opt out of receiving any future text messages by simply replying to any of our text messages at any time with the word STOP. By signing up for our products or programs, you hereby grant us permission to text you until you reply STOP. We do not ever sell or rent your phone number, and we only communicate with you regarding relevant MS4Y programs.

Results and Earnings Disclaimer

We don’t believe in “get rich” programs—only in hard work, adding value, building a real and professional career, and serving others with excellence and discipline. Achieving success requires time, effort, and persistence. If you’re looking for a quick fix or overnight results, our programs are not for you. While we provide tools, strategies, and education, your success depends entirely on your commitment and execution. As stipulated by law, we do not make any guarantees about your ability to get results or earn any money with our ideas, information, tools, or strategies.

Parental Permission

Participants under 18 must be accompanied by a chaperone unless written permission is provided by a parent or legal guardian, and prior approval is granted by the Company.

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us here. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Explicit Language and Mature Content

We will not use explicit language or “curse words” on our Sites. If we find explicit language, as defined by our sole discretion, in any comments or communications posted on our Sites by any users, we reserve the right to delete such language, in whole or in part, at our sole discretion.

Confidentiality and Non-Compete

Users of our Sites hereby understand that the tools, processes, strategies, materials, and information presented on our Sites are copyrighted and proprietary. Users agree not to record, duplicate, distribute, teach, train, or benefit financially from our information in any manner whatsoever without our express written permission. Any unauthorized use, distribution, or selling of our Site’s proprietary concepts, materials, and intellectual property, in whole or in part, by you or your representatives is prohibited, and we will pursue legal action and full damages to protect our rights if these terms are violated in any manner.

Governing Law and Jurisdiction

These Terms of Service shall be interpreted under the laws of North Carolina. Please extend us the courtesy and contact us regarding any issues that you may have so we can resolve any concerns that you may have.
